Terms of Service (FreshEnough)

By accessing this website or placing an order, you agree to these Terms.

1) About our products (surplus / short-date / overstock)

FreshEnough sells surplus, short-date, past-date, and overstock products at discounted prices. Product listings may include best-by/use-by dates, lot codes, packaging notes, and/or condition notes.

Best-by dates generally relate to peak quality, not necessarily safety. Customers are responsible for reviewing product details, including date information, before purchasing.

2) Food, supplement, and personal-care disclaimers

  • Food & beverages: Storage conditions after delivery can affect quality (heat, moisture, transit time). We are not responsible for quality changes caused by improper storage after delivery.

  • Supplements & health products: Information on our site is for general informational purposes only and is not medical advice. Always consult a qualified professional if you have questions. Do not use products if you are allergic or sensitive to ingredients.

  • Personal-care items: Packaging and formulation may vary by manufacturer batch. Follow product directions and discontinue use if irritation occurs.

3) Product accuracy & availability

We work to keep listings accurate, but we do not guarantee that descriptions, images, dates, ingredients, or other content are complete, current, or error-free. Manufacturers may change packaging and ingredients without notice.

Inventory is limited and may sell out. If an item becomes unavailable after you order, we may cancel and refund that item or the full order.

4) Orders, pricing, and payment

All orders are subject to acceptance and verification. We reserve the right to:

  • cancel/refund any order due to pricing errors, listing mistakes, inventory issues, suspected fraud, resale/abuse patterns, or payment problems;

  • limit quantities per customer, household, or order;

  • request additional verification before shipping.

Payment must be authorized and received before shipment unless otherwise stated at checkout.

5) Shipping, delivery, and risk of loss

Shipping times are estimates and not guaranteed. Delays may occur due to carrier issues, weather, holidays, or other circumstances outside our control.

Risk of loss passes to the customer upon delivery to the address provided at checkout (or as otherwise defined by the carrier tracking). Customers are responsible for providing an accurate shipping address.

6) Returns, refunds, and chargebacks

Returns/refunds are governed by our Refund Policy. By placing an order, you agree to follow the return process described there.

If you initiate a chargeback without contacting us first, we may suspend future orders until the issue is resolved.

7) Customer responsibilities

You agree not to misuse the site, attempt unauthorized access, scrape content, or interfere with site performance. You may not use our site for unlawful purposes.

8) Intellectual property

Intellectual property & trademarks
All original site content created by FreshEnough (including our logo, site design/layout, custom text, graphics, photos we produce, and other original materials) is owned by FreshEnough and may not be copied or reused without written permission.

Third-party trademarks, brand names, and product images that appear on this site (for example: Starbucks and other brands) are the property of their respective owners. Any such marks are used only to identify the products being sold and for informational/descriptive purposes. FreshEnough is not affiliated with, sponsored by, or endorsed by these brand owners unless explicitly stated.

If you are a trademark owner (or authorized agent) and believe content on our site infringes your rights, please contact us at help@freshenoughshop.com with:

  • Your name/company and proof of ownership/authorization

  • the specific URL(s) in question

  • What you want removed/changed

We will review and respond promptly and, where appropriate, remove or update the content.

9) Limitation of liability

To the fullest extent permitted by law, FreshEnough (and its owners, employees, and partners) is not liable for any indirect, incidental, special, or consequential damages arising from use of the site or products.

Our total liability for any claim will not exceed the amount paid for the specific order giving rise to the claim.

10) No warranties

Products and services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability or fitness for a particular purpose, to the extent permitted by law.

11) Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
